1. Scope, deadlines
1.1 The business transaction and delivery are exclusively to the present GTC.The following terms conflicting or deviating terms and conditions are not applicable.
1.2 The customer is "consumer", as far as the contract concerns a service of the usual consumption, which is intended for the personal or familial use of the buyer.If the products are not intended for personal or family needs, the customer qualifies as an "entrepreneur".
2.1 You will be responsible for the truthful and complete information provided when entering your personal data in order to register.You are obliged to treat the personal access data confidentially and not to make it accessible to unauthorized third parties.The confirmation of registration will follow immediately after the application has been submitted.
2.2 We are not obliged to accept the registration or the order of a registered customer.We are not obligated to keep our offer permanently available.Confirmed orders remain unaffected.
3. Storage option and access to contract text
3.1 You can always view our current Terms and Conditions via a link.
You can also print or save this document by using the usual function of your Internet utility.
3.2 You can view your order history at any time under "My Account".In addition, you will receive an automatic order confirmation, which we will also send you by e-mail after completing your order to the e-mail address you provided.This order confirmation email contains once more the data of your order and can be printed or saved with your e-mail program.
3.3 Your order data will be saved, but for security reasons not directly available from you.We offer a password-protected direct access ("My Account") for each customer.Here you can, upon registration, view data about your completed, open and recently sent orders and manage and save your address data, any payment details and any notifications.
4. Language and contract
4.1 Contracts can only be concluded in the following languages: German.We do not offer products for sale by minors.If you are under 18, the co-operation of the parent or guardian is required.
4.2 By clicking on the button "Buy" you place a binding order of the items contained in the shopping cart.The confirmation of receipt of the order follows immediately after the order has been sent.All products are only sold in normal household quantities.
4.3 A binding contract only comes about with the transmission of a separate order acceptance, at the latest, however, with delivery of the ordered goods.
4.4 Note that the delivery of the ordered goods in advance (reservation) only after the full amount has been credited to our account.If your payment despite the due date, even after renewed request not received until a date of 7 calendar days after sending the order confirmation with us, your order is void.The order is then done for you and for us without further consequences.
5. Delivery / prices / shipping costs
5.1 The delivery options and times are indicated on our website or in the shopping cart without obligation.However, our details are only binding in our order acceptance for your respective order.
5.2 The prices quoted include VAT as far as we are subject to VAT.Any applicable value added tax will be shown separately in the shopping cart before the final order.
5.3 Any applicable shipping costs are shown separately in the shopping cart during the ordering process when selecting the shipping options and before the final order.
5.4 The minimum order quantity in the online shop for shipping is CHF 30.00.The shipping fee per shipping is CHF 7.00.If you pick us up at Unteren Bahnhofstrasse 12, 8640 Rapperswil, the minimum order quantity as well as the shipping and handling fee are waived.
5.5 Floor mop units are delivered for cost reasons not by post but by DPD courier directly from JEMAKO Germany.The shipping costs are therefore only CHF 7.00.This also applies to larger orders of canister goods for cleaning agents.
5.6 New customers receive a first-customer discount from us and a customer loyalty discount for additional orders.These are not shown in the shopping cart total when ordering online.However, you will receive an order confirmation with the stated discount from us.This is also deducted automatically in the settlement.
5.7 Additional shipping costs for repeated shipping, triggered by address rejection of the postal service, as a result of incorrect address information of the online shop purchaser, shall be borne by the online shop purchaser.
5.8 The shipping of the products is generally on account.For larger orders from CHF 1'000 will be shipped on advance payment.
5.9 For returns we automatically create a credit balance of the returned products, which will be deducted at the next order.
6. Payment arrangements
6.1 Our invoices are payable within 30 days without deduction.If the payment period is exceeded, we are entitled to charge interest of 6%.
In the case of several payment delays, a new delivery will automatically be made only in advance.
6.2 We reserve the right to charge unauthorized deductions.
6.3 Reminder costs and collection charges shall be borne by the customer.
6.4 The customer can change the payment method stored in his user account at any time.
6.5 The obligation of the customer to pay default interest does not exclude the assertion of further damages caused by us.
7. Retention of title
7.1 Until full payment, the goods remain our property.You agree that we may register the retention of title in your name and on your account in the appropriate register.If we have to assert the retention of title to you, we reserve the right to charge you for the costs of registering the retention of title.
8. Warranty, guarantee
8.1 We are liable for material defects in accordance with the relevant statutory provisions, in particular Art. 197 ff OR.Compared to entrepreneurs, the warranty obligation for goods delivered by us is 12 months.
8.2 An additional guarantee exists with the goods supplied by us only if this was expressly delivered in the order confirmation to the respective article.
9. Warranty, liability
Unless otherwise agreed, the warranty and liability are based on the statutory provisions.
10. Right of withdrawal
Agreement on the bearing of costs: If you make use of your right of withdrawal, you have to bear the regular costs of returning the unused goods, if the delivered goods correspond to those ordered.
You can cancel your contract within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the case before the deadline - by returning the goods.The period begins after receipt of this instruction in text form, but not before receipt of the goods at the recipient.To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.The revocation must be sent to:

Consequences of Withdrawal
In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered.If you can not give us back or give us the received performance as well as uses (eg benefits of use) or partially or only in a deteriorated condition, you have to pay us compensation.For the deterioration of the thing and for drawn uses, you only have to pay compensation if the use or the deterioration is due to a handling of the thing, which goes beyond the examination of the characteristics and the functioning.You only have to pay compensation for drawn benefits if you have used the goods in a manner that goes beyond checking the properties and functioning."Testing the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a retail store.
Transportable items are to be returned at our risk.You have to bear the regular costs of the return, if the delivered goods correspond to those ordered.Obligations to reimburse payments must be fulfilled within 30 days.The period begins for you with the dispatch of your revocation or the thing, for us with their receipt.
1. If possible, send the goods back in their original packaging with all accessories and all packaging components.If necessary, use a protective outer packaging if you no longer have the original packaging to protect against transport damage.
2. Please do not send the goods back to us if possible.
3. Please note that the above paragraphs 1.-2.are not a condition for the effective exercise of the right of withdrawal.
11. Applicable law, jurisdiction
11.1 The law of Switzerland shall apply to contracts between us and the customer, excluding the UN Sales Convention.If the contract between the customer and us is not a consumer contract within the meaning of the Swiss Code of Civil Procedure, the place of jurisdiction for all disputes arising from contractual relationships is our registered office.
12. Change of the general terms and conditions
We are entitled to unilaterally change these terms and conditions - insofar as they have been introduced into the contractual relationship with the customer, insofar as this is necessary to eliminate subsequently arising equivalence disturbances or to adapt to changed legal or technical conditions.Before each new order, you must agree to the current terms and conditions by clicking actively.
13. Severability clause
